Terms of Service

Effective: 2026-05-26. Service provider: QA10 sp. z o.o., ul. Mariacka 37, 40-014 Katowice, Poland (KRS 0001232199).

§ 1. General provisions

These Terms of Service set out the rules for the provision of electronic services by QA10 sp. z o.o. via the website qa10.io and its English version at qa10.io/en, including the rules for entering into electronic service contracts and the complaints procedure.

These Terms constitute the regulations referred to in Article 8 of the Polish Act of 18 July 2002 on the provision of electronic services ("Electronic Services Act").

§ 2. Definitions

  • Provider — QA10 sp. z o.o., registered office in Katowice, Poland, ul. Mariacka 37, 40-014 Katowice, KRS 0001232199, tax ID 9542906279, statistical no. 544435060.
  • Website — the website at qa10.io including all subpages and language versions.
  • User — a natural person, legal person, or organizational unit without legal personality but with legal capacity, using the Website.
  • Consumer — a User who is a natural person entering into a contract with the Provider for purposes not directly related to their business or professional activity (Art. 221 of the Polish Civil Code).
  • Entrepreneur with consumer rights — a sole trader entering into a contract directly related to their business activity, where the contract is not of a professional nature for that person (Art. 38a of the Polish Consumer Rights Act).
  • Electronic Service — service provided by electronic means via the Website.
  • Contact Form — form at /en/kontakt/ for submitting inquiries.
  • Calculator — interactive ROI calculation tool at /en/kalkulator/.
  • PDF Report — digital material provided to the User after completing the lead form.
  • Newsletter — recurring commercial and educational information delivered by electronic means based on the User's consent.
  • Informational Content — articles, glossary, case studies and other educational content published on the Website.

§ 3. Type and scope of electronic services

The Provider offers the following Electronic Services via the Website:

  • access to Informational Content in read-only mode;
  • handling of the Contact Form;
  • access to the Calculator;
  • delivery of the PDF Report after submission of the lead form;
  • Newsletter service.

All Electronic Services are provided free of charge. Use of the Website does not require registration or creation of an account.

Advisory services of the Provider (AIP Audit, Engineering Lab, Funding and others) are governed by separate agreements concluded outside the Website and are not subject to these Terms.

§ 4. Technical requirements

  • an end device with internet access;
  • an up-to-date browser with JavaScript and session cookies enabled (Chrome, Firefox, Safari, Edge — versions released within the last 24 months);
  • an active email account — for the use of the Contact Form, lead form or Newsletter.

§ 5. Rules of use

The User must use the Website in accordance with its intended purpose, applicable law and good practices.

In particular, the following are prohibited:

  • providing content of an unlawful nature (Art. 8(3)(2)(b) of the Electronic Services Act);
  • activities compromising the security of the Website, including code interference, unauthorized access attempts, denial-of-service activities;
  • using the Website to send unsolicited commercial communications or any other form of spam;
  • providing false data in forms or impersonating other persons.

The Provider may at any time cease providing Electronic Services to a User violating these Terms or applicable law — without prior warning.

§ 6. Conclusion and termination of electronic service contracts

The contract for browsing Informational Content is concluded for a definite period and ends when the User leaves the Website.

The contract for the Contact Form, lead form or Newsletter is concluded upon successful submission of the form. It is a one-off contract (Contact Form, lead form) or a continuous contract (Newsletter) and may be terminated by the User at any time by withdrawing consent or by sending a request to hello@qa10.io.

§ 7. Newsletter and commercial communications

The Newsletter is provided free of charge, based on the User's separate consent given when submitting the lead form or subscription form. The consent covers:

  • sending commercial communications by electronic means within the meaning of Art. 10 of the Electronic Services Act and Art. 398 of the Polish Electronic Communications Law;
  • receiving educational materials and information about funding programs (including the Dig.IT educational series).

The consent may be withdrawn at any time — directly via the unsubscribe link in the footer of each message, or by sending a request to hello@qa10.io. Withdrawal of consent does not affect the lawfulness of actions taken before withdrawal.

§ 8. PDF Report (digital content)

The PDF Report is delivered after submission of the lead form and after granting consent to data processing for delivery. The Report constitutes digital content not supplied on a tangible medium within the meaning of Art. 2(5) of the Polish Consumer Rights Act of 30 May 2014.

Performance of the service begins immediately upon the Consumer's consent referred to in Art. 38(13) of the Consumer Rights Act — i.e. consent to commence performance before expiry of the withdrawal period. The Consumer acknowledges that, upon delivery of the PDF Report, they lose the right of withdrawal under Art. 27 of the Consumer Rights Act.

§ 9. Calculator — nature and limitations

The Calculator at /en/kalkulator/ is an estimation tool based on the Activity-Based Costing methodology. Results are indicative and educational in nature.

The Calculator result:

  • does not constitute an offer within the meaning of Art. 66 of the Polish Civil Code;
  • does not constitute a guarantee of achieving any specific financial outcome;
  • does not constitute legal, financial, tax or investment advice;
  • does not bind the Provider to enter into a contract or to provide services on specific terms.

Actual outcomes of implementing solutions proposed by the Provider depend on factors outside the Calculator's scope — including process specifics, source data quality, implementation scope and market conditions.

§ 10. Informational Content — nature and limitations

Informational Content published on the Website (articles, glossary, case studies, methodological materials) is for educational and informational purposes only. It does not constitute legal, tax, financial, technical or business advice. Reliance on it for business decisions is at the User's sole risk.

§ 11. Intellectual property

All content available on the Website — including texts, graphics, audiovisual materials, layout, logos, marks and software — constitutes the exclusive property of the Provider or third parties from whom the Provider has obtained licenses, and is subject to legal protection (in particular under the Polish Act of 4 February 1994 on copyright and related rights).

The User may use Informational Content within the scope of permitted personal use (Art. 23 of the Polish Copyright Act). Any use exceeding this scope — in particular copying, modification, redistribution or commercial use — requires the Provider's prior written consent.

§ 12. Liability

The Provider exercises due care to ensure continuity and proper operation of the Website. The Provider does not guarantee uninterrupted availability — the Website may be temporarily unavailable due to maintenance, updates, failures or circumstances beyond the Provider's control.

Subject to mandatory law, the Provider's liability for non-performance or improper performance of Electronic Services to Users who are neither Consumers nor Entrepreneurs with consumer rights is limited to actual damages incurred, to the exclusion of lost profits. This limitation does not apply to damages caused intentionally (Art. 473 § 2 of the Polish Civil Code).

Towards Consumers and Entrepreneurs with consumer rights, the Provider's liability is governed exclusively by mandatory provisions of applicable law.

§ 13. Complaints

The User has the right to file a complaint concerning the Electronic Services provided by the Provider.

Complaints can be submitted:

  • by email — to hello@qa10.io with the subject line "Complaint";
  • by post — to the Provider's registered address: QA10 sp. z o.o., ul. Mariacka 37, 40-014 Katowice, Poland.

A complaint should include: identification of the User, a description of the issue, the date of the event and the requested resolution. The Provider responds to complaints within 14 days of receipt. Failure to respond within this period — in relation to a Consumer — is deemed to constitute acceptance of the complaint (Art. 7a(2) of the Polish Consumer Rights Act).

§ 14. Out-of-court dispute resolution

Consumers may use out-of-court means of complaint handling and claim assertion, in particular:

  • consumer dispute resolution conducted by the Provincial Trade Inspectorate competent for the Provider's place of business (Katowice) — see uokik.gov.pl;
  • the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr — under Regulation (EU) 524/2013;
  • assistance from municipal or district consumer ombudsmen.

Out-of-court resolution is voluntary and requires the consent of both parties.

§ 15. Personal data protection

The processing of Users' personal data is governed by a separate document: Privacy Policy. The use of cookies is described in the Cookie Policy.

§ 16. Changes to the Terms

The Provider reserves the right to amend these Terms for important reasons, in particular:

  • changes in applicable law affecting the provision of Electronic Services;
  • changes in the scope or method of providing Electronic Services;
  • changes in the Provider's identification or contact details;
  • clarification of provisions raising interpretation doubts.

The Provider notifies Users of changes by publishing the updated version on the Website, indicating the effective date. For the Newsletter and other continuous services, changes are additionally communicated by electronic message sent at least 14 days before they take effect. A User who does not accept the changes may terminate the contract before the new version takes effect.

§ 17. Governing law and jurisdiction

Matters not governed by these Terms are subject to Polish law, in particular the Civil Code, the Electronic Services Act, the Consumer Rights Act, the Electronic Communications Law and the GDPR.

Disputes between the Provider and a User who is neither a Consumer nor an Entrepreneur with consumer rights are subject to the jurisdiction of the common court competent for the Provider's registered office (Katowice). For Consumers and Entrepreneurs with consumer rights, jurisdiction is determined by mandatory provisions of applicable law.

§ 18. Final provisions

These Terms enter into force on 2026-05-26. The Terms are continuously available at qa10.io/en/terms-of-service/ and in the Polish language version at qa10.io/regulamin/. In the event of any discrepancy between language versions, the Polish version prevails.
