1. Does HR automation breach employment law or the Labour Code?
No, if implemented correctly. The Labour Code permits electronic employee records (e-personnel file since 2019), electronic confirmation of employment terms, and electronic leave requests. Qualified electronic signatures have the same legal force as a handwritten signature. Employee consent is required to switch to e-documents, and access to them must be provided on request.
2. Which HR data is sensitive from a GDPR perspective?
All employee data is personal data, and some (e.g. health information, disability certificates) is special category data. The HR system must have: access controls, encryption, access logging, data retention policies (e.g. 10 years after employment termination for payroll records), and a data processing agreement with the system vendor.
3. Is AI in recruitment legal in Poland?
Yes, but with restrictions. The EU AI Regulation (AI Act, applied from 2025) classifies AI systems in recruitment as “high-risk” — they require transparency, the right of appeal, and regular audits for discrimination. AI cannot be used to automatically reject candidates without the possibility of human review.
